Police make drug, drunk driving arrests

— Police arrested Richard Bay, 28, of Rogers, after an officer found Bay passed out at the wheel of a Chevrolet Tahoe and a weapons frisk revealed a prescription pill bottle with four different types of pills in it.

According to the police report, an officer responding to a call about Bay, found him passed out at the wheel at the Phillips 66 station in Gentry. When the officer was able to wake Bay and asked him to step out of the vehicle, Bay nervously reached into his pockets and under the seat, the report states. When Bay finally complied and was frisked for weapons, the Gentry officer found a pillbottle on Bay with another person’s name on it and containing a number of pills the officer identified as being Oxycontin in two different strengths, Aprazolam and hydrocodone.

According to the report, Bay claimed he had picked up the mixed bottle of pills at the pharmacy and was taking them to the person whose name was on the bottle. According to the report, a phone call was made to check Bay’s story but did not lend credence to his claims.

Bay was transported to the Benton County Jail and charged with possession of a Schedule II controlled substance, a Class C felony.

Police also arrested two men for driving while under the influence of alcohol.

David Hamilton, 55, of Garfield, was arrested Oct. 24, after testing more than three times the legal blood alcohol limit.

According to police reports, Hamilton was driving a Ford F-150 pickup truck very slow and made two U-turns in the intersection of Arkansas Highways 12 and 59. Though Hamilton denied drinking, he failed field sobriety tests and was placed under arrest. According to police reports, he tested 0.271 when taking a breath test for blood alcohol content.

The legal blood alcohol limit is .08.

Hamilton was charged with driving while intoxicated, careless and prohibited driving and not having proof of insurance.He was transported to the Benton County Jail.

On October 17, police arrested Jose Macias, 58, of Gentry, after an officer stopped Macias for driving a Volkswagen Beetle without working tail lights and could smell the odor of alcohol coming from inside the car.

Macias denied drinking, according to police reports, but failed a field sobriety test. When a breath test was administered for blood alcohol content, Macias’ results were .203, according to police reports.

Macias was arrested and booked into the Benton County Jail, charged with driving under the influence of alcohol. He was issued a warning for non-functional taillights, according to the police report.
