Judge revokes Fleck’s privileges

She is ordered to have no contact with children

BENTONVILLE - The only outside communication Susan Fleck can have is with her attorney, Circuit Judge Robin Green ruled last month.

Fleck, 32, is charged with capital murder in connection with her husband’s death. She is accused of shooting him to death in their Gentry home in March. She is being held without bond in the Benton County Jail.

Fleck had been ordered not to have any contact with her four children or her deceased husband’s family.

Stephanie McLemore, deputy prosecutor, told Green during a hearing last month that Fleck may have violated the no-contact order by having a third party relay a message to her children. Green reiterated her order again at that hearing and told Fleck she was not to have any contact with her children.

At Monday’s hearing, McLemore told Green that Fleck had mailed a package to her children and her husband’s familyin Colorado. The package contained multiple letters, McLemore said.

There also was a contact attempt with a family member through Facebook, but she could not prove Fleck was responsible, McLemore said.

There also had been telephone calls where Susan Fleck’s voice was heard, McLemore said.

Jay Saxton, chief public defender, said Fleck admitted she wrote the letters.

“She understands that she messed up,” Saxton said.

Green revoked all of Fleck’s communication privileges at the jail. She can not use the telephone to contact anyone and can only write letters to Saxton.

“There are consequences to breaking the nocontact order,” Green told Fleck.

Saxton told Green he will forward messages to Fleck’s family and friends, but will not talk to any of the prohibited individuals.

Evan Fleck was found shot in his bed after Gentry police went to the home in response to a 911 call at about 4 a.m. March 3. Police found the couple’schildren in the basement, according to court documents.

Susan Fleck called Benton County Central Communications from Delaware County, Okla. She told a dispatcher her husband was in the bedroom and he had fi led for divorce, according to court documents.

Evan Fleck filed for divorce Feb. 19, according to court documents. The couple had been married since July 13, 1997.

Delaware County Sheriff’s Office deputies found a green and black Springfield .40-caliber semiautomatic pistol with several rounds still in the magazine after they made contact with Susan Fleck at Twisters, a convenience store in Kansas, Okla., according to court documents.

Proceedings in the case have been suspended pending results of a mental evaluation at the Arkansas State Hospital in Little Rock. A mental status hearing is set for Sept. 30.
