Charges will not be filed against Gravette couple

BENTONVILLE -- Prosecutors will not pursue charges against a Gravette couple who were accused of injuring their 2-month-old daughter.

Deven Randolph, 31, and Holly Randolph, 30, were arrested in July in connection with first-degree battery. The couple appeared in court Dec. 19 for their arraignments. Stuart Cearley, chief deputy prosecutor, announced the prosecutor's office would not file charges in the case.

"After a thorough review of this case that took place over several months, it became clear that the evidence was insufficient to justify the filing of criminal charges," said Nathan Smith, prosecuting attorney.

Attorney Drew Miller, who represents the couple, said the Randolphs are relieved the criminal case is over and they look forward to moving on with their lives.

"They are very close to getting their lives back to some normalcy," Miller said.

Miller said he is grateful the justice system worked and said, once authorities had a chance to look at the case, it was obvious no charges were warranted.

The child was taken to Mercy Medical Center in Rogers on July 22, then moved by helicopter to Children's Hospital in Little Rock, according to court documents. The baby girl had bleeding from the brain, fractures to the left femur and tibia, a fracture to the left forearm, fluid on the spine and injuries to a kidney, according to the affidavit.

A Children's Hospital doctor said the injuries are consistent with child abuse, mainly shaken baby syndrome. The doctor reported the baby would be incapable of causing the injuries to herself, according to court documents.

Miller said the girl has recovered and is "doing great."
